中華人民共和國(guó)國(guó)務(wù)院關(guān)于在中國(guó)國(guó)際貿(mào)易促進(jìn)委員會(huì)內(nèi)設(shè)立海事仲裁委員會(huì)的決定(附英文)

(一九五八年十一月二十一日國(guó)務(wù)院全體會(huì)議第八十二次會(huì)議通過)

為了以仲裁方式解決海事爭(zhēng)議,需要在有關(guān)的社會(huì)團(tuán)體內(nèi)設(shè)立海事仲裁機(jī)構(gòu),茲決定:

一、在中國(guó)國(guó)際貿(mào)易促進(jìn)委員會(huì)內(nèi)設(shè)立海事仲裁委員會(huì),以解決:

⒈關(guān)于海上船舶互相救助、海上船舶和內(nèi)河船舶互相救助的報(bào)酬的爭(zhēng)議;

⒉關(guān)于海上船舶碰撞、海上船舶和內(nèi)河船舶碰撞或者海上船舶損壞港口建筑物或設(shè)備所發(fā)生的爭(zhēng)議;

⒊關(guān)于海上船舶租賃業(yè)務(wù)、海上船舶代理業(yè)務(wù)和根據(jù)運(yùn)輸合同、提單或者其他運(yùn)輸文件而辦理的海上運(yùn)輸業(yè)務(wù)以及海上保險(xiǎn)等所發(fā)生的爭(zhēng)議。(注解:海事仲裁委員會(huì)受理案件的范圍,國(guó)務(wù)院辦公廳一九八二年九月二日的通知中有新規(guī)定。)

二、海事仲裁委員會(huì)根據(jù)雙方當(dāng)事人在爭(zhēng)議發(fā)生前或者爭(zhēng)議發(fā)生后所簽訂的契約、協(xié)議等受理海事爭(zhēng)議案件。

海事仲裁委員會(huì)對(duì)于所受理的案件,可以進(jìn)行調(diào)解。

三、海事仲裁委員會(huì)由中國(guó)國(guó)際貿(mào)易促進(jìn)委員會(huì)在對(duì)于航海、海上運(yùn)輸、對(duì)外貿(mào)易、保險(xiǎn)和法律等方面具有專門知識(shí)的人士中選任委員二十一人至三十一人組成。任期二年。

四、海事仲裁委員會(huì)就委員中推選主席一人、副主席一人至三人。

五、雙方當(dāng)事人在聲請(qǐng)仲裁爭(zhēng)議案件的時(shí)候,各就海事仲裁委員會(huì)委員中選定仲裁員一人,并且由雙方選定的仲裁員就海事仲裁委員會(huì)委員中推選首席仲裁員一人,組成仲裁庭以合議方式進(jìn)行審理。雙方當(dāng)事人也可以就海事仲裁委員會(huì)委員中共同選定獨(dú)任仲裁員一人,單獨(dú)成立仲裁庭進(jìn)行審理。

雙方當(dāng)事人應(yīng)當(dāng)在海事仲裁委員會(huì)規(guī)定的期限內(nèi),或者在雙方協(xié)議規(guī)定的期限內(nèi)選定仲裁員,被選定的仲裁員也應(yīng)當(dāng)在海事仲裁委員會(huì)規(guī)定的期限內(nèi)推選首席仲裁員。如果一方當(dāng)事人在規(guī)定期限內(nèi)不選定仲裁員,海事仲裁委員會(huì)主席依他方當(dāng)事人的聲請(qǐng),代為指定仲裁員;如果被選定或者指定的仲裁員,對(duì)首席仲裁員的推選,在規(guī)定期限內(nèi)不能達(dá)成協(xié)議,就由海事仲裁委員會(huì)主席代為選任首席仲裁員。

六、雙方當(dāng)事人的任何一方都可以委托海事仲裁委員會(huì)選定仲裁員,會(huì)同他方的仲裁員推選首席仲裁員組成仲裁庭以合議方式審理爭(zhēng)議案件。如果雙方同意共同委托海事仲裁委員會(huì)選定仲裁員,海事仲裁委員會(huì)主席可以指定仲裁員一人,單獨(dú)成立仲裁庭進(jìn)行審理。

七、雙方當(dāng)事人在海事仲裁委員會(huì)審理爭(zhēng)議案件的時(shí)候,可以委派代理人以保護(hù)自己的利益。

前項(xiàng)代理人可以由中華人民共和國(guó)公民或者外國(guó)公民擔(dān)任。

八、對(duì)于海事仲裁委員會(huì)有權(quán)受理的案件,委員會(huì)主席可以作出保全措施的決定,并且規(guī)定保全要求的數(shù)額和方式。

前項(xiàng)決定,由中華人民共和國(guó)人民法院依一方當(dāng)事人的聲請(qǐng)依法執(zhí)行。

九、海事仲裁委員會(huì)可以征收仲裁手續(xù)費(fèi),手續(xù)費(fèi)金額不可以超過爭(zhēng)議金額的百分之二。

十、海事仲裁委員會(huì)的裁決是終局裁決,雙方當(dāng)事人都不可以向法院或者其他機(jī)關(guān)提出變更的要求。

十一、海事仲裁委員會(huì)的裁決,當(dāng)事人應(yīng)當(dāng)依照裁決所規(guī)定的期限自動(dòng)執(zhí)行。如果逾期不執(zhí)行,中華人民共和國(guó)人民法院依一方當(dāng)事人的聲請(qǐng)依法執(zhí)行。

十二、有關(guān)仲裁程序的規(guī)則,由中國(guó)國(guó)際貿(mào)易促進(jìn)委員會(huì)制定。

DECISION OF THE STATE COUNCIL OF THE PEOPLE'S REPUBLIC OF CHINA

CONCERNING THE ESTABLISHMENT OF A MARITIME ARBITRATION COMMISSION WITH

IN THE CHINA COUNCIL FOR THE PROMOTION OF INTERNATIONAL TRADE

(Adopted at the 82nd Meeting of the State Council on November 21,

1958)

With a view to settling maritime disputes through arbitration, it is

necessary to set up an arbitral body within a relevant social

organization. It is hereby decided as follows:

1. There shall be established within the China Council for the Promotion

of International Trade a Maritime Arbitration Commission [*1] to settle:

a. disputes over the remuneration for salvage services rendered by sea-

going vessels to each other or by a sea-going vessel to a river craft or

vice versa;

b. disputes arising from collisions between sea-going vessels or between

sea-going vessels and river craft or from damages caused by sea-going

vessels to harbour structures or installations;

c. disputes arising from chartering sea-going vessels, agency services

rendered to sea-going vessels, carriage by sea in virtue of contracts of

affreightment, bills of lading or other shipping documents, as well as

disputes arising from marine insurance.

2. The Maritime Arbitration Commission takes cognizance of maritime

disputes in accordance with the relevant contracts, agreements and or

other documents concluded between the disputing parties either prior or

subsequent to the occurrence of disputes. The Maritime Arbitration

Commission may endeavour to settle through mediation any dispute of which

it has taken cognizance.

3. The Maritime Arbitration Commission shall be composed of 21-31 members

to be selected and appointed by the China Council for the Promotion of

International Trade for a term of two years from among persons having

special knowledge in navigation, sea transportation, foreign trade,

insurance and law.

4. The Maritime Arbitration Commission shall elect a Chairman and 1-3

Vice-Chairmen from among its members.

5. When a dispute is submitted for arbitration, the disputing parties

shall each choose an arbitrator from among the members of the Maritime

Arbitration Commission. The arbitrators so chosen shall jointly select

from among the members of the Maritime Arbitration Commission a presiding

arbitrator to form, in association with the arbitrators, an Arbitration

Tribunal to act in a body. The disputing parties may also jointly choose

from among the members of the Maritime Arbitration Commission a sole

arbitrator to form by himself a Tribunal to act singly.

The disputing parties shall choose the arbitrators within the time fixed

by the Maritime Arbitration Commission or agreed upon between the parties,

and the arbitrators so chosen shall also select the presiding arbitrator

within the time fixed by the Maritime Arbitration Commission. If one of

the parties fails to choose an arbitrator within the prescribed time

limit, the Chairman of the Maritime Arbitration Commission shall then,

upon the request of the other party, appoint the arbitrator for the former

party. If the arbitrators so chosen or appointed cannot agree upon the

choice of the presiding arbitrator within the prescribed time limit, the

Chairman of the Maritime Arbitration Commission shall then select a

presiding arbitrator for them.

6. Either of the parties in dispute may authorize the Maritime Arbitration

Commission to choose for him an arbitrator who shall, jointly with the

arbitrator chosen by the other party, select a presiding arbitrator to

form, in association with the arbitrators, an Arbitration Tribunal to act

in a body. If, by mutual agreement, both parties jointly delegate the

choice of arbitrators to the Maritime Arbitration Commission, the Chairman

of the Maritime Arbitration Commission, may appoint a sole arbitrator to

form by himself a Tribunal to act singly.

7. The disputing parties may appoint attorneys to protect their interests

during the proceedings of a case before the Maritime Arbitration

Commission.

Such attorneys may be citizens of the People's Republic of China or

foreign citizens.

8. In cases within the cognizance of the Maritime Arbitration Commission,

the Chairman of the Maritime Arbitration Commission may make decisions in

respect of measures of security and determine the amount and form of the

security for the claim. Upon the request of one of the parties, the

People's Court of the People's Republic of China shall enforce the

decision referred to in the preceding paragraph in accordance with the

law.

9. The Maritime Arbitration Commission may collect an arbitration fee not

exceeding two per cent of the amount of the claim.

10. The award handed down by the Maritime Arbitration Commission is final

and neither party shall bring an appeal for revision before a court of law

or any other organization.

11. The award by the Maritime Arbitration Commission shall be executed by

the parties themselves within the time fixed by the award. In case an

award is not executed after the expiration of the fixed time, the People's

Court of the People's Republic of China shall, upon the request of one of

the parties, enforce it in accordance with the law.

12. Rules concerning the Procedure of Arbitration shall be formulated by

the China Council for the Promotion of International Trade.
